Explanation of the Bills: |
| SONDA (S.782/Sexual Orientation Non-Discrimination Act)/STATED POSITION: Adds sexual orientation to the state’s existing laws prohibiting discrimination in employment, housing, public accommodations, education, and credit on the basis of age, race, creed, color, national origin, sex, disability, or marital status. Pride Agenda’s position: SUPPORT. |

Hate Crimes (S.2303)/MOTION TO DISCHARGE: Sen. Duane’s version of the Bias Related Violence & Intimidation Act; makes bias related violence and intimidation, including hate violence based on sexual orientation, a distinct criminal offense and mandates that the sentence for bias related violence or intimidation run consecutive to any other sentence imposed. Sen. Duane brought a motion to discharge the bill (i.e., force the bill from committee to an immediate floor vote). The motion failed 30 to 24 on strict party lines on April 13. Pride Agenda’s position: SUPPORT. |

Late Term Abortion (S.1638): Creates the crime of partial birth abortion, a class E felony. The bill’s language is so vague that it can be read to apply to virtually any abortion. Passed the Senate 41 to 18 on March 24. Pride Agenda’s position: OPPOSE. |

Stalking (S.1241): Forbids conduct constituting the criminal interference with health care services. The bill’s definition of "immediate family" (for purposes of determining whether certain acts constitute stalking) includes persons who currently reside together or who have resided together in the past, thus including lesbian and gay couples and their families. It does not extend the jurisdiction of Family Court to victims of stalking who are unmarried or unrelated by blood or a child in common. Passed the Senate on February 2 and May 4. Pride Agenda’s position: SUPPORT. (In August, the Senate and Assembly reached agreement on a compromise Stalking bill, that includes protections for "religious worship" and the Senate is expected to pass the compromise bill during the fall of 1999.) |
